EXCALIBUR DIGITAL makes Kraken Spin Legend available to you on the condition that you agree to these Terms of Service.

These Terms apply to Kraken Spin Legend in the context of its app presentation. The theme and interface are part of the app experience and do not create external ownership or transferable rights unless a separate official notice says so.
Use the app only for ordinary personal access and do not interfere with security, availability, advertising, measurement, or support systems.

Third-Party Login: You may connect your Kraken Spin Legend account to Google Play Games. Your use of those services is subject to Apple's or Google's terms.

EXCALIBUR DIGITAL licenses Kraken Spin Legend to you — rather than selling it — on the terms described below.
What We Grant You
Subject to these Terms, EXCALIBUR DIGITAL grants you a:
- Limited license (specific conditions apply)
- Personal license (for your use only, not transferable)
- Non-exclusive license (others can have the same right)
- Revocable license (we can end it if you violate these Terms)

Game Currency Terms
This section explains the rules surrounding virtual currencies and items in Kraken Spin Legend.
Important: Virtual currency and items have no real-money value. They are digital licenses for in-game use only and cannot be exchanged for cash.
Acquiring virtual currency or items grants you a revocable license to use those game features — not ownership of any digital property.
We May Modify the Virtual Economy
EXCALIBUR DIGITAL may adjust virtual item values, availability, and pricing as we update Kraken Spin Legend. We'll try not to disadvantage players who have already made purchases.
Account Termination: Virtual currency and items are non-refundable and non-transferable if your account is terminated for cause.
No Real-Money Trading: Selling or trading virtual items for real money outside the game is prohibited.

Permitted Uses: You're welcome to share gameplay clips, screenshots, and reviews on social media for personal, non-commercial purposes. We love seeing players share their experience!
What You May NOT Do
- Sell, redistribute, or commercially exploit Kraken Spin Legend's content
- Create unauthorized merchandise featuring our characters or art
- Claim ownership of our content
- Remove copyright or trademark notices
- Use our trademarks without written permission

No Availability Guarantee

Limitation of Liability

No Indirect Damages
To the maximum extent permitted by law, EXCALIBUR DIGITAL is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Kraken Spin Legend, even if we were advised of the possibility of such damages.
If EXCALIBUR DIGITAL is found liable for any claim, our total liability is capped at the amount you paid us in the 12 months before the claim arose, or $100 USD — whichever is greater.
Exceptions: These limits don't apply to liability that cannot be excluded under applicable law, including liability for fraud, gross negligence, or death or personal injury caused by our negligence.
These liability limitations are an essential part of the agreement between you and EXCALIBUR DIGITAL. Without them, we could not provide Kraken Spin Legend at its current price.

User Indemnification
Your agreement to these Terms includes accepting responsibility for claims resulting from your conduct in Kraken Spin Legend.
You Agree to Indemnify Us
You agree to defend, indemnify, and hold harmless EXCALIBUR DIGITAL, its affiliates, officers, and employees from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your violation of these Terms
- Your use or misuse of Kraken Spin Legend
- Your misuse of the app
- Your violation of third-party rights or applicable law
We may choose to handle the defense of indemnified claims ourselves. If we do, you agree to cooperate fully and not to settle the claim without our written consent.
We will promptly notify you of any claim subject to indemnification and work with you in good faith to resolve it fairly.

Dispute Resolution
EXCALIBUR DIGITAL is committed to resolving disputes fairly and efficiently. Here's how we do it.
Most disputes can be resolved with a simple conversation. Please email our support team first. If we can't resolve your issue within 30 days, you may proceed to formal dispute resolution.
Binding Arbitration: Unresolved disputes will proceed to binding individual arbitration, conducted in English, in accordance with the rules of a recognized arbitration body.
No Class Actions
You agree to resolve disputes with EXCALIBUR DIGITAL on an individual basis only. You waive any right to participate in class action or group proceedings.
Exceptions: Either party may seek emergency injunctive relief from a court of competent jurisdiction. Individual small claims actions are also exempt from this arbitration agreement.

Account Termination
These Terms continue until terminated. Here's how that process works.
You have the right to stop using Kraken Spin Legend and close your account at any time without penalty. Email our support team to request account deletion.
Termination for Cause: We may immediately suspend or terminate accounts involved in cheating, fraud, hate speech, or other serious violations, without prior notice when necessary to protect our community.
When your account is terminated: (1) access ends; (2) earned virtual items may be forfeited; (3) provisions that by nature survive (IP, indemnity, arbitration) remain enforceable.

Applicable Law
These Terms are governed by a specific set of laws. This section explains which legal system applies.
The laws applicable in the jurisdiction where EXCALIBUR DIGITAL is registered govern these Terms, without giving effect to conflict-of-law principles.
Courts: Subject to the arbitration agreement, any legal proceedings not resolved through arbitration shall be brought in courts of competent jurisdiction in EXCALIBUR DIGITAL's governing jurisdiction. Both parties consent to personal jurisdiction.
Consumer Law Exception: Mandatory consumer protection laws in your country of residence apply to the extent they cannot be overridden by this Agreement.

How We Change the Terms
We review our Terms periodically and update them when needed. Here's our update process.
We distinguish between material and minor changes. For material updates (new data practices, new fees, IP rights changes), we provide at least 14 days of advance notice via in-app notification.
The effective date shown on these Terms is the date they apply. Using the app after this date confirms your acceptance.
You always have the option to discontinue use if you disagree with revised Terms. Your continued use is acceptance; departure is always an option.

General Provisions
Entire Agreement
These Terms, along with our Privacy Policy and any additional policies referenced herein, form the complete agreement between you and EXCALIBUR DIGITAL regarding Kraken Spin Legend, and replace any prior agreements on the same subject.
Severability
If any part of these Terms is found to be invalid or unenforceable, that part will be interpreted to be as close to the original intent as possible, and the remaining parts continue in full effect.
No Waiver
If we don't enforce a provision of these Terms in a particular instance, that doesn't mean we're giving up our right to enforce it in the future.
Assignment
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations to a successor company in the event of a merger or acquisition.
